Where Do I Begin After a Serious Accident?

Injury victims will often find themselves in a hospital with a hundred questions after a crash: Where is my car?  How did I get here? What am I supposed to do?

First and foremost, an injury victim should remain calm and make sure their medical condition is stable. Once your health is stabilized, you can begin to deal with what needs to be done. After an accident that causes injuries, there will be two main issues you need to address: Property Damage and Personal Injury Damages. Below is some basic information on both topics:

  • Property Damage: The property damage side of the case deals with getting your vehicle and any other damaged property repaired and/or replaced. If you have full insurance coverage, the fastest way to have your car repaired or replaced is to contact your own insurance company. They will take care of the cost of repair or replacement and then go after the responsibly parties insurance company for reimbursement.

However, if you only carry liability coverage, your insurance will not repair or replace your vehicle. In this situation, you will need to have your car repaired/replaced by the responsible party’s insurance company. After a crash, the at-fault parties insurance company will conduct an investigation into the facts of the crash before making payment. They will often wait until the police report is prepared which commonly takes 7-10 days.  (For fatal car accidents the reports can take in excess of 30 days to prepare). Once the police report is reviewed and they have interviewed the parties, they will make their liability determination. If it is in your favor, they will pay to repair or replace the vehicle.

NOTE: If your vehicle is totaled and the insurance company pays to replace your vehicle, you should make sure to ask for a sales tax waiver for the new car you will have to buy. It is not fair for you to have to pay sales tax again when the crash was not your fault.

NOTE: It is extremely important to speak to a lawyer for personal injuries before providing statements to any insurance company. Insurance agents are trained to ask questions which benefit their insured.

  • Personal Injury Damages: The personal injury side of the case is much more complex. Insurance companies work hard to pay as little as possible for your injuries after a crash. These companies make a massive profit by bringing in more in premiums than they pay out in claims. It is crucial that you contact an injury lawyer after an accident to discuss the many aspects that go into handling a personal injury case.
