Fibromyalgia – Accident Injuries

Fibromyalgia is commonly found in the population at large. An article in the Journal of Internal Medicine states that Fibromyalgia is present in approximately 6-15% of the population. Of these 6-15%, a study in the British Journal of Rheumatology found that 15% of the patients first started to experience symptoms following a physical trauma.

The medical community and literature recognizes that symptoms of fibromyalgia following a whiplash injury is fairly common.  According to WebMD.com, the symptoms of fibromyalgia may include:

  • Muscle Pain, Spasms, Tightness
  • Weakness in the Limbs
  • Leg Cramps
  • Tension or Migraine Headaches
  • Numbness or Tingling in the Face, Arms, Hands, Legs, or Feet
  • A Feeling of Swelling in the Hands or Feet
  • Dizziness
  • Severe to Moderate Fatigue

Patients suffering from Fibromyalgia face a difficult future. Fybromyalgia symptoms often intensify depending on the time of day, weather, stress, and several other factors of daily life. In addition, the symptoms of fibromyalgia may last for several days, weeks, months, or turn into a chronic condition. According to WebMD.com, if the condition is not diagnosed and treated immediately, symptoms may become chronic and last indefinitely. In addition, symptoms may disappear and reoccur months later, leading the patient to falsely believe they have recovered from their condition.

The American College of Rheumatology (ACR) has developed a diagnostic testing methodology to assist in diagnosing fibromyalgia. The ACR looks for: 1) A history of widespread pain for more than three months, and 2) Pain in 11 of 18 tender points upon palpation (See diagram below). “Palpation” is a diagnostic method of feeling and pushing with the fingers or hands during a physical examination. Generally a doctor touches and feels the patient’s body to determine the size, consistency, location, texture and/or tenderness of a body part.

Fibromyalgia is a condition that plagues many accident and traumatic injury victims. Despite the available data, insurance companies commonly try to blame fibromyalgia on other factors in an attempt to escape liability. Following a traumatic injury, accident victims are entitled to reimbursement for all of their harms and losses related to the accident: past, present and future. It is important for Missouri accident victims to ensure they have fully recovered from accident related fibromyalgia prior to accepting any settlement from an insurance company.

Insurance companies are able to save billions of dollars each year by rushing accident victims to settle their injury case immediately following an accident. In cases such as fibromyalgia where symptoms may reoccur months later, it is important that accident victims consult with their medical professionals prior to accepting any money related to their case.

For additional information on fibromyalgia and accident victims rights, contact a Missouri accident lawyer. Once settlement is accepted for an injury, regardless of the necessity of any future medical treatment, you have likely permanently released the at fault party for all future liability. This common misunderstanding costs accidents victims countless millions of dollars each year. Contact a Fibromyalgia injury lawyer immediately following your accident for vital information necessary to counter the tactics of large insurance corporations.
