Caps On Non-Economic Damages For Medical Malpractice

An action against a health care provider for personal injury or death has some restrictions. Missouri Statutes Section 538.210 says that in such a lawsuit any non-economic damages are capped at about $400,000 for “non catastrophic” injuries and $700,000 for “catastrophic” injuries. Those caps are tied to inflation and will increase over time. “Catastrophic” is defined as an “injury resulting in quadriplegia, paraplegia, the loss of two or more limbs, significant and permanent cognitive impairment, irreversible failure of a major organ, or significant loss of vision.”

Comparative Fault

It is important for injury victims to understand that in Missouri they do not have to be completely blameless in order to receive compensation. Missouri follows s rule called “pure comparative fault,” which tries to divide up the blame between the parties. So if a customer slips on a dangerously-wet floor of a supermarket, but the customer was not paying close attention to where he was walking, the supermarket could still be forced to pay for the injuries. The supermarket might be found 70% at fault for leaving its floor dangerously slippery while the customer could be 30% at fault for not paying attention. In that scenario, the customer would likely be awarded 70% of the damages he or she incurred. In short, no victim should fail to explore a claim just because they will shoulder some blame.
