Survivorship Actions

Most people would agree that someone who wrongfully injures another person should not be let off the hook for damages if the person that they injured dies. The law addresses this problem with what is often called a survivorship law. Missouri’s survivorship law is in Statutes Section 537.010 and 537.020. The law simply says that the estate of a deceased person can bring an action for any claims that the deceased person could have brought if he or she was still alive, as “the liability and the measure of damages shall be the same as if such death or deaths had not occurred.” In fact, a representative can be appointed to an estate that otherwise has no money simply to collect on a lawsuit.

Wrongful Death

A wrongful death action is where a family member can recover for the damages they suffered because of the loss of a loved one. These lawsuits are not intended to compensate for damages that the deceased person suffered. Instead, they are intended to try to help the deceased person’s family to put their lives back together. Lost earning capacity is usually the biggest part of any damages in a wrongful death case. If someone loses a parent, for example, they will lose the stream of income that parent would have earned and used to take care of his or her children. Wrongful death suits often allow family members to recover for more intangible losses as well, such as the value of the instruction and guidance that a parent would have given over the rest of his or her life.

Missouri law lays out specific damages that can be recovered by family members in Statutes Section 537.080 and 537.090. The law allows the spouse or children of a deceased person to recover for “funeral expenses, and the reasonable value of the services, consortium, companionship, comfort, instruction, guidance, counsel, training, and support.” The judge or jury can consider the “mitigating or aggravating” circumstances of the death as well, but damages for grief or bereavement cannot be recovered. The law also provides that if a spouse or child is not available to maintain a wrongful death suit, then a sibling, or nieces and nephews, can file a lawsuit. If no family is available then someone else can be appointed.
