Road Accidents Responsible For More Wrongful Deaths in Missouri

In the last twelve months, the state of Missouri saw 818 deaths due to traffic accidents. This was a 4 percent rise on what had previously been an obvious six-year downward trend. Missouri is not alone in having an unacceptable fatality rate. In the city of Kansas alone, fatalities topped the Missouri state figure by reaching its highest rate in the last nine years.

Why is the Fatality Rate on the Rise?

There is uncertainty as to the reason for these alarming increases when traffic regulations and road monitoring, using the most sophisticated techniques, has been in force for a number of years. The Missouri State Patrolmen have recently revealed in a report that a new category seems to be in evidence causing recent traffic fatalities and that is the use of the cell phone while driving. There is clear evidence that this behavior has contributed to some of the crashes and distracted driving is clearly on the rise.

Another feature identified by troopers as a notable factor relates to crashes caused by motorists whose right-side tires hit the pavement. Drivers tried to correct this deviation by either staying off the road and crashing or turning sharply as an immediate reaction, causing them to find head into oncoming traffic. Not paying due care and attention or being distracted was cited as the reason a motorist’s tires drifted onto the sidewalk, as well as speeding around a curve in the road

Normal reasons for fatalities in road crashes, such as failure to buckle up, don’t seem to have showed any rise in the 2012 data as it was about the same number as the previous year. The number of fatalities caused by impaired drivers actually fell to 40 percent.

Police have however noted more single-car crashes than usual and more victims in the 20’s age range, with 31 percent of the 65 deaths affecting 20 to 29 year. Individuals in this age range are often responsible for texting while driving accidents.

Pedestrian accident fatalities increased from three to nine between 2011 and 2012 and five of these were due to intoxication. Overall, at eight of top intersections in the state, failing to pay attention was the main reasons for accidents.

St. Louis Wrongful Death Attorney

Often, fatalities on our roads are not the fault of the victim and may mean the bereaved family can put in a wrongful death claim to help to compensate for the loss of a loved one. A St. Louis wrongful death lawyer knows how to submit appropriate claims to those who caused the fatality.

Wrongful death is the commonly used legal term for any fatality where the carelessness, recklessness or negligence of another person has caused a fatal accident. How fatal injuries are treated often varies between states, but whether the death occurred in a truck accident, a car accident, through medical malpractice, or even abuse in a nursing home it is only specific family members who can file a wrongful death lawsuit.  There are also laws which outline what actually can be recovered and they are divided into non-economic and economic damages. Non-economic damages are emotional losses which are always difficult to quantify as all wrongful deaths are such sad events and present such devastating loss to those related to the person.

Economic damages are more specific and include medical expenses, funeral expenses, and loss of income. When a family loses one of their members in a wrongful death there is not just the emotional losses, but often the victim has been a breadwinner and has contributed to the family’s budget which may now be lost forever. These sorts of losses can be calculated as a precise figure. In the event of formulating an exact amount, a wrongful death lawyer will ensure an economist will do the calculation so that the right figure is an accurate representation of the true financial loss. There is no maximum figure set on economic damages.

Anyone who is trying to fight for economic justice in a wrongful death case will have to bear the onslaught of the insurance agents and lawyers of the defendant. These people do not necessarily represent justice and will try to evade taking responsibility for paying the true economic and non-economic value of a wrongful death loss. Fatal accident cases can be complex and are not the ones to trust to an inexperienced lawyer. Many families pursue a wrongful death claim as they want to be certain that someone is formally established as responsible for their devastating loss and prevent future members of the community from sustaining similar injuries.

It doesn’t matter where you live in Missouri, if you’ve lost someone you love in a fatal accident that was not their fault and require the services of a Missouri wrongful death lawyer, then don’t hesitate to call us for a free consultation to discuss your situation.

Missouri Wrongful Death Time Limit

There is always a time limit when filing a wrongful death claim in Missouri. It is specified in the state’s statute of limitations. In Missouri, it is three years from the actual time of death and no longer. It is necessary to put in a claim as soon as possible and as close to the date of the wrongful death where the facts are still clear in the mind. If you fail to use your legal entitlements when it comes to furnishing a claim, then you are not truly punishing the person at fault of the wrongful death and their behavior will not change. If you want to protect others from experiencing similar wrongful death situations, then you shouldn’t hesitate.
