The damages cap was struck down several years ago when the Missouri Supreme Court said the caps unconstitutionally limited the public’s right to a jury trial. Ms. Watts was awarded $3.371 million to help care for her permanently-disabled son and $1.45 million in noneconomic damages and that was the end of Missouri’s recovery cap for a while.

The hospitals and insurance company lobbyists fought back, though, and in 2015 the Missouri legislature created a new cap system. This law is now Missouri Statutes Section 538.210 and it says that in a lawsuit against a health care provider any noneconomic damages are capped at $400,000 for “non catastrophic” injuries and $700,000 for “catastrophic” injuries. These caps will increase over time with inflation. “Catastrophic” is defined as an “injury resulting in quadriplegia, paraplegia, the loss of two or more limbs, significant and permanent cognitive impairment, irreversible failure of a major organ, or significant loss of vision.”
