Helmets and Licensing

Missouri Statutes Section 302.020 says that a motorcycle operators must have a valid license, which is only issued after an examination conducted by the Department of Motor Vehicles. The examination will test a rider on basic vehicle control and crash-avoidance skills. Missouri has age restrictions for motorcycles as well. Riders must be 18 to obtain a regular license, though they can get a limited permit at age 15 and a half.

Missouri also requires riders to wear “protective headgear at all times the vehicle is in motion.” The state legislature has repeatedly considered changing this motorcycle crash law to allow riders to choose to ride without a helmet if they want, but so far the changes have not be passed. It is also worth noting that the fine for violating the helmet law is only $25.

Because of the helmet laws, people sometimes think that they cannot be compensated for their injuries if they crashed while they were not wearing a helmet. That is not the case. Missouri follows a rule called “pure comparative fault,” which means that fault for an accident can be divided up among two or more parties even if each side is partially responsible for the accident. So if a car driver hits a motorcycle rider who was not wearing a helmet and the motorcycle rider breaks a leg and gets a concussion, the rider might be 20% at fault and the car driver might be 80% at fault. In that case, the rider would recoup 80% of his damages.

Insurance Requirements

Missouri Statutes Section 303.025 requires that every motor vehicle operator in the state must “maintain the financial responsibility which conforms to the requirements of the laws of this state.” This is generally accomplished by purchasing insurance, and motorcycles are included in the definition of motor vehicles. The minimum levels of insurance laid out in Statutes Section 303.020(10) is up to $25,000 per person for bodily injury, $50,000 per accident for bodily injury, and $10,000 per accident for property.

Lane Splitting

Another law that many people ask about is “lane splitting,” which is riding a motorcycle between lanes or rows of slow moving traffic. It is also sometimes called lane sharing, whitelining, filtering, or stripe-riding. Missouri law is not very clear on this practice, but the Missouri Department of Transportation tells riders that “riding between rows of stopped or moving cars is illegal in Missouri.” Riding side by side with another motorcyclist is also discouraged.
