What is Carbon Monoxide Poisoning?

Carbon monoxide is a byproduct that is produced by fire. That means it is present in a vehicle’s exhaust, and is released by a gas-fired stove, grill, or heater. As explained by the Centers for Disease Control and Prevention, carbon monoxide poisoning can cause “flu-like symptoms” like a headache, dizziness, weakness, upset stomach, vomiting, chest pain and confusion. Breathing in too much carbon monoxide can be fatal.

Everyone should take some basic precautions to protect their homes, and commercial establishments that fail to take these precautions could be held liable for any harm they cause. First, every home should have a carbon monoxide detector with a working battery that is replaced at least every five years. Heating and water systems should be serviced by a professional every year. Refrigerator problems should be checked immediately, and any gas equipment you purchase should be approved by a national testing agency like the Underwriters’ Laboratories. Gas appliances and fireplaces need to be vented properly, and fire-based cookers like charcoal grills or gas camp stoves should never be used inside. Garages should be well ventilated, and generators should never be used indoors.

Who is Liable for Carbon Monoxide Poisoning?

Carbon monoxide claims can be challenging because a device that releases carbon monoxide is not inherently unsafe. A car or a generator is not going to kill you if you use them properly. When somebody dies after making a mistake like leaving their car running in the garage overnight, it is hard to argue that anyone is responsible other than the person that tragically died. That said, carbon monoxide poisoning is sometimes caused by a defective product. For example, faulty furnaces will sometimes emit fumes and that could be the fault of either the furnace company or a company in charge of maintaining the building where the furnace was installed.
