Catastrophic Injuries St. Louis

Accident victims will often contact our office telling us they have suffered “catastrophic injuries.” This is not necessarily a common legal term. Additionally, the Missouri legislature actually has made “catastrophic personal injury” a meaningful legal term by adjusting caps on damages based on whether the injury was “catastrophic.”

Caps on Catastrophic Damages in Missouri

In the American legal system, we count on juries made up of individuals from the local community to determine how much money should be awarded to compensate a wrongfully-injured person for his or her injuries. Unfortunately, in recent years the very conservative state legislature in Missouri has done the bidding of large insurance companies and worked to cap jury awards.

As explained in the Missouri Law Review, California became the first state to cap damages back in 1975. Missouri followed suit in 1986, saying that an injured person could not collect more than $350,000 in non-economic damages in a medical-malpractice lawsuit. This includes pain, suffering, mental anguish, physical impairment, disfigurement, loss of capacity to enjoy life, and loss of consortium (i.e. ability to enjoy sexual relations). This law changed a few times over the years, and then in 2006 a woman named Deborah Watts went to the doctor because she was 39 weeks pregnant and worried about her baby. The doctor was slow to react, and after a much-delayed caesarean section delivery Ms. Watts’ son was born with catastrophic brain injuries.

Ms. Watts filed suit and was awarded $3.371 million to help care for her permanently-disabled son and $1.45 million in noneconomic damages. This award was reduced to the cap of $350,000, but Ms. Watts appealed. After years of winding through the legal system, the case wound up in front of the Missouri Supreme Court and in 2012 the Court ruled that the $350,000 cap was unconstitutional because it violated Ms. Watts’ right to a jury trial.

The big insurance companies would not take the repeal of their caps lying down, though. In 2015, the legislature created a new cap system under a new law that the legislature believes does not have the same jury requirements. Missouri Statutes Section 538.210 now says that in a lawsuit against a health care provider any noneconomic damages are capped at $400,000 for “non catastrophic” injuries and $700,000 for “catastrophic” injuries. These caps will increase over time with inflation. Catastrophic is defined as an “injury resulting in quadriplegia, paraplegia, the loss of two or more limbs, significant and permanent cognitive impairment, irreversible failure of a major organ, or significant loss of vision.”
