Chris Dixon

Founder and Managing Attorney

I pride myself on tirelessly fighting for car accident victims who continuously trust me with their cases. It is an honor to serve and a passion which drives my existence.

The Federal Employers’ Liability Act (FELA) protects railroad workers that are injured or killed on the job. If a railroad worker suffers traumatic brain injuries, repetitive injuries, or becomes paralyzed while performing the duties of their job, under FELA, the victim could have a valid Missouri FELA injury claim. If you are struggling with unexpected medical expenses or severe pain after a railroad accident in Missouri, you need to consult the Dixon Injury Firm’s St. Louis FELA Accident Lawyers right away and determine if you are entitled to FELA benefits from your employer.

Who Is Covered Under FELA?

The Federal Employer Liability Act was established in 1908 to protect the rights of injured rail workers and provide support and access to compensation during the aftermath of a work-related railroad accident. Under FELA, any railroad employee that is injured on the job due to an employer, equipment manufacturer, or coworker’s negligence can sue the negligent party for damages related to the accident.

Most Missouri FELA claims are eligible to recover compensation for injuries and losses caused on the job, but it’s vital to the success of your claim to collect as much evidence from the accident as possible. Like other workers’ compensation claims, recovering compensation for railroad accident-related injuries requires detailed proof of the other party’s fault in the situation, evidence of your harm or losses, and proof of your right to sue the other party for your injuries.

Common FELA Accident Claims | St. Louis FELA Accident Lawyers

The Federal Railroad Administration enforces U.S. railroad safety regulations and ensures that railroad employees are safe and protected from carelessness by an employer, manufacturer, and other work-related party’s. The most commonly reported FELA accident claims include:

  • Hazardous materials and occupational exposure
  • Improper safety training and operator inexperience
  • Unmaintained/defective railroad equipment
  • Inadequate crew or improper rail-crossing etiquette
  • Harm by foreign objects or a fellow employee

According to the National Safety Council, 8,136 people suffered catastrophic injuries in U.S. railroad accidents in 2018, with the most common accidents occurring at railroad crossings involving railroad operator inexperience.

Missouri FELA Accident Lawsuits

In May 2019, the Federal Railroad Administration voided state laws on crew size, while the state legislature enforces a minimum crew size of two. While there isn’t concrete evidence, according to the state legislative, maintaining a crew size of at least two railroad workers enables safer operations.

Recently, this has lead to eight U.S. freight railroad companies filing lawsuits against the railroad union, International Association of Sheet Metal, Air, Rail and Transportation Workers – Transportation Division (SMART-TD), stating that the union is refusing to acknowledge the issue.

If you or someone you love has been injured in a railroad accident in Missouri, or have experienced safety issues related to crew size, you could be eligible to join the class-action lawsuit against SMART-TD or file a Missouri railroad accident claim against the person responsible for your injuries.
