Most people think of trains as safer than airplanes, but that has seemed less true in recent years. In March 2017, a Texas tour bus apparently got lost and wound up stuck on a train track while as a freight train came barreling towards it. Four people on the bus were killed, and around 40 were injured. Apparently, this crossing had led to more than a dozen other vehicles getting hit in the past, but nothing had been done about it.

More publicity was given to railroad accidents / injuries involving New York commuter trains like the January 2017 derailment in Brooklyn, New York. In that case the train just kept rolling at full speed as it approached its stop, eventually striking at a high speed the “bumping block” where it was supposed to park. Luckily, nobody died in that crash but more than 100 were injured. This was eerily similar to a 2016 crash in Hoboken, New Jersey. In that crash a commuter train again pulled into a station without stopping and also injured about 100 people, but in that case one woman died after being hit by falling debris.

The real eye opener for train safety for most people came in 2015, when an Amtrak train hit a curve outside Philadelphia and its distracted engineer allowed the train to speed up to twice the speed limit for that part of the track. The train was allowed to go 80 miles per hour on a straight stretch just outside a station in Philadelphia, but then comes a curve when the train needed to be below 50 miles per hour, then after the curve trains are allowed to accelerate to 110 miles per hour. The engineer apparently thought he was through the curve already, so he started speeding up and the train jumped the tracks going around 106 miles per hour. Eight people died in the crash and nearly 200 were injured.

Let Chris Dixon Help Explain Your Possible Claims

People who have suffered railroad accidents / injuries usually do not know where to turn. If it is a mass casualty event, victims may wind up at an overcrowded hospital trying to figure out what to do. Train accident victims will often be far from home as well. The Philadelphia Amtrak train that derailed, for example, was on its way from Washington, D.C. to New York. Many of the victims did not have any plans to be in Philadelphia and had no idea what to do next. In such an event it often makes sense to hire a lawyer closer to home. Rail accident victims may also want to band together into larger groups to pursue their claims together, but you may want to consult a lawyer focused solely on your own needs before joining a larger group.

Another thing to be aware of is that Congress has set a cap on liability for rail accidents. This was done as part of a bailout for Amtrak back in 1997, and Congress set the bar at a level that seemed very high at the time, $200 million. That was quickly found to be inadequate after the Philadelphia derailment, as the destruction caused by the wreck changed the lives of so many people. Congress eventually agreed to raise the cap and Amtrak began to settle claims. It is presumed that Amtrak paid all or nearly all of the cap in damages.
